Terms of Service

These Terms of Service (the “Terms”) govern your access to AdForge KZ and your purchase and use of our digital advertising creative products. By creating an order, accepting these Terms, or using a delivered product, you agree to them. If you do not agree, do not place an order.

1. Supplier and contact details

The product supplier is Omar Ismail Saituly, registered in the Republic of Kazakhstan as IE OMAR (Individual Entrepreneur), IIN 070721552781, registration date 7 August 2026, and trading as AdForge KZ (“AdForge KZ”, “we”, “us”, or “our”). IE OMAR uses the generally established taxation regime. Our business address is Astana International Airport, 119 Kabanbay Batyr Avenue, Astana, Republic of Kazakhstan. 2. Product

AdForge KZ is self-service cloud software. The AdForge AI Advertising Video is a $30 one-time purchase that uses a customer brief and approved brand assets to generate one original 10–15 second vertical advertising video. It does not include a manually performed design service, marketing consultancy, campaign management, or media buying. The deliverables, price, currency, digital format, and other package details shown before payment form part of your order. It is not a subscription and does not renew.

We use automated and artificial-intelligence tools to develop visuals, advertising copy, narration, music, and quality checks. AI-generated content can contain variations or artifacts. We do not guarantee sales, leads, views, platform approval, or any particular advertising result.

3. Eligibility and business use

You must be at least 18 years old and legally capable of entering a contract. If you order for a company or another person, you confirm that you are authorized to bind them. You are responsible for determining whether the product is suitable and lawful for your business, industry, audience, and advertising channels.

4. Orders, prices, and payment

You must review and correct your brief, contact details, package, and price before paying. An order is accepted when payment is confirmed and we make the product available for production, unless we reject or cancel it and arrange a refund. Prices and applicable taxes are shown at checkout. Price changes do not affect an already completed transaction.

For transactions presented through FastSpring, FastSpring is the merchant of record and authorized reseller. You purchase the product from FastSpring under the applicable FastSpring Terms of Sale, while these Terms govern your use of the AdForge KZ product. FastSpring processes payment, applicable transaction taxes, receipts, refunds, and chargebacks. If another payment method is displayed at checkout, the terms disclosed for that method also apply.

5. Production and delivery

Production may begin promptly after payment because each product is personalized. Estimated completion times are targets, not guarantees, and third-party provider capacity may cause delay. Most videos are delivered within 15 minutes after a valid brief is submitted, but this is an estimate and not a guaranteed deadline. Delivery occurs when the finished MP4 is made available in your account or through another secure delivery method we identify. Delivered files remain available for at least 30 calendar days. You are responsible for downloading and safely backing up your files during that period.

If a technical issue prevents or unreasonably delays delivery, we will use reasonable efforts to complete or replace the product. If we cannot provide a technically usable product, the remedy in our Refund Policy applies.

6. Customer materials and instructions

You retain your rights in logos, photographs, trademarks, copy, and other materials you submit. You grant us and our processors a worldwide, non-exclusive, royalty-free license to host, copy, modify, transmit, and process those materials only as reasonably necessary to provide, secure, support, and improve the ordered service. This license ends when the material is deleted, except for protected backups and records we must retain by law.

You confirm that you have all rights, permissions, and lawful grounds required for submitted materials and personal data. You are responsible for the accuracy of names, offers, prices, claims, contact details, and instructions in your brief.

7. Acceptable use

You must not use the service or a delivered product to:

• violate any law, regulation, court order, or third-party right;
• infringe intellectual-property, privacy, publicity, or data-protection rights;
• create deceptive, defamatory, hateful, exploitative, or discriminatory content;
• promote unlawful goods, services, conduct, or dangerous misinformation;
• submit malware, credentials, or content intended to interfere with the service;
• misrepresent AI-generated people, events, endorsements, or claims as verified facts; or
• resell access to the platform, reverse engineer it, or bypass security or usage limits.

We may reject, suspend, or cancel an order that reasonably appears to violate these rules. Refund eligibility in that situation depends on work already performed, mandatory law, and the applicable payment-provider rules.

8. Rights in the delivered product

After full payment, we grant you a worldwide, perpetual, royalty-free, non-exclusive license to use, reproduce, edit, publish, and display the final delivered video for your lawful business and advertising purposes. You may allow your employees, agencies, and advertising platforms to use them for those purposes. You may not resell the files as stock assets, templates, or standalone creative products.

You retain ownership of your original materials. We retain our platform, software, workflows, templates, know-how, and other pre-existing materials. Third-party assets and services remain subject to their own rights. Because generative outputs may not be unique and the legal protection of AI-generated material varies by country, we do not promise exclusivity, trademark availability, or copyright registration eligibility.

9. Technical defects, regenerations, and refunds

Our Refund Policy forms part of these Terms. It explains qualifying technical defects, the seven-day reporting process, one free technical regeneration, and when a full refund is available. Nothing in these Terms limits a mandatory consumer right. For FastSpring transactions, requests and approved refunds are processed by FastSpring to the original payment method under FastSpring's applicable Terms of Sale.

10. Service availability, suspension, and termination

We may maintain, change, or discontinue parts of the service, but this does not remove our obligation to deliver or appropriately remedy an accepted paid order. We may restrict access to protect customers, providers, or the platform; investigate fraud or security incidents; comply with law; or address a material breach of these Terms. You may stop using the service at any time. Provisions that by their nature should survive termination, including payment, intellectual-property, liability, and dispute provisions, will survive.

11. Disclaimers and limitation of liability

We provide the service with reasonable care and skill. Except for rights and warranties that cannot lawfully be excluded, the service and AI-generated content are provided without additional express or implied warranties, including a guarantee of uninterrupted provider availability or advertising performance.

To the maximum extent permitted by law, IE OMAR is not liable for indirect, incidental, special, punitive, or consequential loss; lost profit, revenue, opportunity, goodwill, or data; or a third-party platform's rejection or removal of an advertisement. To the maximum extent permitted by law, our total liability arising from an order will not exceed the amount paid for that order. These limits do not apply where liability cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

12. Governing law and disputes

These product-supplier Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules. Courts with jurisdiction in Astana, Kazakhstan will have jurisdiction over disputes with IE OMAR, subject to any mandatory consumer right to bring a claim elsewhere. FastSpring transactions are also governed by the FastSpring Terms of Sale, including the FastSpring entity and governing-law provisions applicable to the buyer.

Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally. This does not prevent either party from seeking urgent relief or using a mandatory complaint or consumer-protection process.

13. General terms

If any provision is unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver. We are not responsible for delay caused by events beyond our reasonable control, but we remain responsible for remedies required by law. You may not assign these Terms without our consent; we may assign them as part of a lawful business transfer without reducing your rights. These Terms, the order summary, the Refund Policy, and the Privacy Policy form the agreement between you and IE OMAR for the product.

14. Changes

We may update these Terms prospectively. The date above identifies the current version. Material changes will not retroactively reduce rights attached to a completed order. Your continued use after an update takes effect means you accept the updated Terms where allowed by law.
